This website provides general information on a class action settlement that affects the rights of all persons who engaged the services or retained Marsh & McLennan Companies, Inc. (“Marsh”) or any other Broker in connection with the purchase or renewal of insurance or reinsurance from any insurer during the period from August 26, 1994 through September 1, 2005.

The Marsh Settlement has been reached in a class action lawsuit alleging that Brokers and Insurer Defendants, including Marsh, engaged in an insurance brokerage scheme involving the receipt of undisclosed payments or kickbacks from insurance carriers, steering insurance policyholders to carriers paying the most in “contingent commissions,” and rigging bids for insurance policies, all allegedly in violation of law and to the detriment of insurance policyholders. Marsh denies any allegations asserted by the Settlement Class, but has agreed to a Settlement that includes the establishment of a settlement fund of more than $69 million.

A hearing was held on December 15, 2008, at which the Court considered whether to finally approve the Settlement and related matters described in the Notice Packet. The Court finally approved the settlement on February 17, 2009. Appeals from the Court's final approval order are now pending.

If you are a Settlement Class Member who purchased or renewed a policy during the period August 26, 1994 through September 1, 2005 where any insurance brokerage and related administrative, advisory or claim services were provided by Marsh or another Broker, and you wish to be considered for a distribution from the settlement fund in the event that the Court finally approves the Settlement, you must submit a properly completed Claim Form (see link at left). Claim Forms should have been mailed to the Settlement Administrator and postmarked no later than March 31, 2009 and the deadline to submit a timely Claim Form has passed. You may still submit a Claim Form, however it will be marked "LATE" and no determination has yet been made concerning the acceptance or rejection of late Claim Forms.
